Terms and Conditions

1. Invoicing and Payment

An invoice will be issued with each completed job upon return. At the end of each calendar month, a statement will be provided detailing all items supplied and the total outstanding balance for that month. All accounts are payable within 30 days of the statement date.

2. Overdue Accounts

The laboratory reserves the right to charge interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, as amended. Any applicable interest and debt recovery costs permitted under the legislation may be added to the outstanding balance.

3. Pricing

All prices are correct at the time of publication and are subject to change without prior notice.

Unless otherwise stated, all prices include packaging and delivery.

4. Remakes

Remakes may be charged at the discretion of the laboratory.

5. Invoice Queries

Any discrepancies or errors on an invoice must be reported within 21 days of the invoice date. After this period, the invoice shall be deemed accepted as correct and the full amount will become payable.

6. Client Instructions and Specifications

All appliances are manufactured strictly in accordance with the instructions, prescriptions, impressions, scans, measurements, and specifications provided by the client.

The laboratory accepts no responsibility for the suitability, accuracy, completeness, or appropriateness of any instructions, prescriptions, impressions, scans, measurements, or specifications supplied by the client.

7. Responsibility of the Prescribing Dentist

The prescribing dentist remains solely responsible for the diagnosis, treatment planning, prescription, fitting, adjustment, and clinical suitability of any appliance supplied by the laboratory.

The client must inspect and verify the suitability, fit, function, and accuracy of all appliances prior to fitting or use on a patient.

8. Quality and Faults

The laboratory endeavours to manufacture all appliances to the highest possible standard and in accordance with the client’s instructions.

Any fault, defect, discrepancy, or concern must be reported to the laboratory prior to fitting so that any necessary adjustments or corrections can be made.

9. Acceptance of Work

The fitting, adjustment, insertion, or use of an appliance shall constitute acceptance by the client that the appliance has been manufactured in accordance with the client’s instructions and is satisfactory for its intended purpose.

10. Delivery

The laboratory will use reasonable endeavours to complete and deliver work on or before the delivery date requested by the client.

However, delivery dates are estimates only and are not guaranteed. The laboratory shall not be liable for any dentist’s fees, patient claims, loss of earnings, consequential losses, costs, damages, or expenses arising from any delay in delivery.

11. Errors and Corrections

The laboratory will use reasonable endeavours to interpret and follow the client’s instructions accurately.

In the event of an error attributable to the laboratory, the laboratory’s sole obligation shall be to correct, adjust, or remake the appliance as soon as reasonably practicable.

The laboratory shall not be liable for any dentist’s fees, patient claims, consequential losses, loss of profits, costs, damages, or expenses of any kind.

12. Limitation of Liability

To the fullest extent permitted by law, the laboratory’s total liability in connection with any order shall be limited to the amount charged by the laboratory for the appliance or service concerned.

The laboratory shall not be liable for any indirect, special, incidental, or consequential losses, including loss of profit, loss of revenue, loss of goodwill, or professional fees.

Nothing in these Terms and Conditions shall exclude or limit liability where such exclusion or limitation is prohibited by law.

13. Cancellation of Orders

As all appliances are custom manufactured to the client’s specification, orders may not be cancelled once production has commenced.

The laboratory reserves the right to charge for work completed, materials used, and any costs incurred up to the date of cancellation.

14. Retention of Title

Ownership of all goods supplied by the laboratory shall remain with the laboratory until payment has been received in full for all sums due from the client.

15. Force Majeure

The laboratory shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, epidemic, pandemic, industrial disputes, transport disruption, power failure, supplier shortages, equipment failure, or governmental action.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Additional Terms and Conditions

These Terms and Conditions should be read in conjunction with the laboratory’s full Terms and Conditions, which are available upon request.

By placing an order with the laboratory, the client confirms acceptance of these Terms and Conditions and any additional terms made available by the laboratory upon request.
